The Nigerian Bar Association (NBA) as part of its public policy scheme has partnered with MacArthur Foundation on an advocacy project to ensure successful domestication and implementation of the Administration of the Criminal Justice Act, 2015 in 28 States of the Federation who are yet to be ACJA compliant.

There has over time been an insistent clamor for the reform of the Nigeria Criminal Justice System as the system is saddled with fundamental flaws and defects that make it impossible to address present day issues, crimes and criminal procedure. This in return has created a lacuna in the justice system.

The introduction of the Administration of the Criminal Justice Act, 2015, (ACJA) which is a welcome development seeks to address most of the issues affecting the effectiveness and functionality of the Nigeria Criminal Justice System. One of the key provisions of the new ACJA include Section 2 of the Act which prescribes that the law is applicable in all Federal courts and with respect to offences contained in Federal Legislation.

The ACJA seeks to correct the lacuna in the repealed Criminal Procedure Act and Criminal Procedure Code by adopting a more acceptable trend used in the evidence Act, 2011 where person standing trial for criminal offences are not described as “accused persons” but as “defendants”

Since the introduction of the Criminal Justice Act, 2015, a total number of 8 States of the Federation have successfully domesticated the Act with the inclusion of the FCT and Lagos State. It is evident that there is need for increased efforts to promote the domestication and harmonized implementation of the ACJA across Nigeria in order to tackle existing and emerging areas of crime and ensure effective and efficient administration of criminal justice.
